A man who blinded a fellow bar patron by poking him in the eye was sentenced Tuesday to a year in jail, with more than 8-1/2 years hanging over his head if he violates terms of his probation.

It was early New Year's Day at Governors Fine Food & Drink when Kinseth Sorlien of St. Paul took offense at another man who wished a happy holiday to Sorlien's mother, according to a criminal complaint in the case.

Kent Gunter, who was 51 at the time, told police that Sorlien's mother had walked up to him, hugged him and wished him Happy New Year, the complaint said. Sorlien slapped the back of Gunter's head.

When Gunter objected, Sorlien left the bar. But he returned and poked Gunter in the eye, the man told police.

Among the witnesses in the bar, at 959 Arcade St. in St. Paul's Payne-Phalen neighborhood, was a woman making balloon animals. She said Gunter, a St. Paul resident, was injured so severely that he had tissue leaking from one of his eye sockets.

A group walking on the street about 1:30 a.m. flagged down police and alerted them to the incident.

Sorlien, 34, was convicted Aug. 28 by a Ramsey County jury on one count of first-degree assault.

Judge George Stephenson sentenced him to a year in jail and 20 years of probation. If he fails to follow all terms of his probation, including no use of alcohol or drugs and staying away from Governors bar, he'll face a prison term of more than 8-1/2 years.

The stayed sentence was a departure from the state sentencing guidelines. Sorlien's attorney, Eric Nelson, said the judge determined that Sorlien was a good candidate for probation and that he would have a better opportunity to pay restitution to Gunter than if he were imprisoned.

Gunter posted a photo of himself on Facebook the day after the attack. He later wrote, "The last picture with both real eyes."
